It's a really common misconception that you only need a Will in later life or if you have significant assets. In reality, every individual should have a Will - young or old, rich or poor. There are lots of reasons to make a Will and if you haven't done so already, we recommend you read our page 'Why make a Will' setting out at least 10 good reasons to do so.
We assist all individuals from all backgrounds, those in the prime of their life, older and vulnerable individuals, landowners, business owners, married couples, civil partners and divorcees.
We fully understand that family dynamics and relationships can be complicated and this is often the cause of delay in making their Wills. A staggering number of people put off making a Will, so if you are reading this and don't have a Will, we would urge you to reconsider and make one as soon as possible.
It's going to be complicated isn't it?
The answer is 'No'. It can actually be straightforward because we have the expertise to make Wills for every type of relationship and those with blended families.
We can also help you address the dilemmas which often present when deciding how to structure your Will, what provisions to include and how to frame suitable provision for beneficiaries. We can also offer advice about how to tackle the thorny and sensitive problems caused by family dispute and estrangements which can feel overwhelming when planning what will happen to your estate on death.
I'm not sure what's involved in making a Will -what should I expect?
We appreciate that for most people instructing a solicitor and making a Will is not an everyday occurrence. Let's face it - the thought of all that legal jargon is enough to think twice and we do understand that you may feel daunted for all sorts of reasons. But please don't be swayed against the idea - it's actually simple.
The starting point is for you to know that we are friendly and down to earth and we want to help you. We take the time to get to know our clients, listen to and understand what concerns them. If you have the time to talk to us, we'll make the time to listen to you so we can give you considered advice, tailored to your individual needs.
For this reason, we offer a free initial consultation to all our clients. It affords us the occasion to listen to you and identify if and how we can help and it allows you an opportunity to discuss your circumstances and consider your options, without obligation, to decide if you would like us to help you.
At our Initial Consultation for our Wills Service, we will take some information from you about your personal circumstances and discuss what you want to happen to your assets when you die and other provisions you wish to make, advising you and helping you to explore and understand the various options.
We advise you about how Inheritance Tax may apply to your Estate on death and help you plan ahead to mitigate the effect.
We also discuss using trusts to protect family property and the effect of care home fees. More information on this topic can be found on the Trusts page of our website.
We never put you on the spot or pressure you to give instructions. Making a Will is a considered process. It may be that you want to reflect on the options we have discussed together or talk these over with your family following our initial appointment. The purpose of the initial meeting is for us to take information from you and provide you with the advice you need to make decisions about the content of your Will.
If you wish to proceed with the preparation of your Will, once you have confirmed your final instructions to us on the content, we will prepare a draft document based on your instructions and we will send this to you with an explanatory letter. If you wish to amend your Will at this stage, we are happy to do so in accordance with your instructions .
Once the draft Will is in a final format, we prepare an engrossed Will ready for your signature. We arrange to meet with you to sign the Will and ensure that it is executed correctly.
We offer to store your Will securely, free of charge, if you wish. In that event, we will provide you with copies of the executed Will for your own records.
We are available to offer advice and address any queries or concerns throughout the entire process. No question can be too silly and no worry too small.
It's going to be expensive isn't it?
The answer is 'No'. Of course we charge for our expertise but we believe that our work carried out via Richard Nelson LLP at reasonable fixed fees, approved by you after an initial free consultation, represents really good value for money. We provide you with helpful and practical advice and produce a bespoke Will tailored to fit you. When measured against the Peace of Mind a Will delivers to you and your family, isn't this a worthwhile investment?
WHAT IF I ALREADY HAVE A WILL?
We also assist individuals who already have Wills. We normally recommend everyone should review their Wills every 3-5 years - a Will M.O.T if you like - to ensure everything still works and it's fit for purpose. Life moves on and sometimes so does the law. When your circumstances change or new regulations come into force, it's possible your Will needs to be updated too. Marriage, Divorce, Death of a family member, births, sale & purchase of property and acquisition of wealth are just some of the triggers to review your Will.
We understand that it is difficult to decide how life events might impact on your existing Wills and so we offer a free review of any existing Will - whether you are an existing client or not. We will advise you about the content of your existing Will in the context of any change of circumstances and recommend any necessary changes. If you do decide to amend your Will this may require drafting a completely new Will or perhaps drafting a Codicil as an addendum to the existing Will. We will be able to advise what is most appropriate in your case and the cost of making any necessary amendments you wish.
Wills are what we do. Put simply, we use our expertise to ensure your loved ones or those organisations you care about can benefit exactly as you plan to deliver Peace of Mind for you!
If you need to make a Will or want to review an existing Will, please do not hesitate to let us know - we would be happy to assist you!
